Unmarketable work as a Jackson Pollock: "Spring nº 11" or "Untitled White 11"

In 2012, I compiled a report on an alleged artwork by Jackson Pollock (based on the work’s signature and style) entitled “Spring nº 11” or “Untitled White 11” (the “Work”), which was prepared for and intended to be disclosed exclusively to the Pollock-Krasner Foundation for consultation purposes (as explicitly stated in the report). After a thorough investigation into the Work’s marketability, I concluded that, given the exclusion of the Work from the author’s catalogue raisonné, and the Jackson Pollock Estate’s legal position regarding any newfound works, the Work could not be officially validated as an original artwork by Jackson Pollock.


All the information contained in my report was provided to me by the owner’s legal agents, which I had no possibility of verifying despite my investigation, and such information was only included in the report to facilitate the verification by the Jackson Pollock Estate. Hence, the information contained within my report is by no means a statement of facts, and any use of my report to argue the contrary is inappropriate and unlawful. More importantly, I never used, or intended for, my report to market this Work, nor did I authorize anyone to do so, as I knew it could not be marketed as a Jackson Pollock painting so long as the industry’s status quo on the authentication and validation of works by Jackson Pollock endured.


Today, as in 2012, this Work cannot be officially labeled as an authentic work by Jackson Pollock, and anyone who decides to acquire it as such is doing so at their own risk.


I am publishing this note because it has recently come to my attention that my report is being fraudulently used to deceive potential art buyers on the authorship and authenticity of that Work. I would also like to add that any use of my report in any matter without my express authorization is in violation of my legal rights and copyright as an author in accordance with Sections I and II of Chapter III of the Intellectual Property Law of the Kingdom of Spain (1996) and Article 428 of Chapter III from Title IV of the Civil Code of the Laws of the Kingdom of Spain, the applicable jurisdiction for this particular matter.


If I learn of the unauthorized use of my report by anyone, I intend to pursue all available legal remedies, including seeking monetary damages, injunctive relief, and an order to pay court costs and attorney’s fees. Liability and exposure under such legal action could be considerable.

The backside includes a Stadler Gallery sticker attached to the painting with a well preserved red seal of the gallery itself. There is also the inscription “Lenore K.P. to France #1952#” in the lower part of the painting’s stretcher.
